Edward J. Estrada
Edward J. Estrada is co-head of Reed Smith's U.S. Commercial Litigation Group. He is also a member of the Financial Industry Group, specializing in the Hedge Fund and Commercial Restructuring & Bankruptcy Groups. His practice focuses on the financial services sector, including the representation of banking interests and private investment funds in connection with their investment strategies, disputes and in their efforts to identify, protect and enforce rights and claims. Ed has played a significant role in the representation of financial institutions, lenders and other investors in litigation, alternative dispute resolution, bankruptcy proceedings and out-of-court restructurings. Such representations often include the analysis and interpretation of complex financing documents, extensive negotiations and the vigorous pursuit of client rights at the trial or bankruptcy level and before appellate courts.
Mr. Estrada has also represented indenture trustees, secured and unsecured creditors, debtors, and creditors' committees as part of his bankruptcy practice. In his representation of corporate trust departments, Ed has represented clients in various trustee roles involving the negotiation and defense of bondholder rights and claims, including the marketing, negotiation and sale of aircraft and engines in several airline bankruptcies.
Representative Matters
- Representation of offshore liquidator as largest creditor and plan proponent of U.S. based debtors, including the pursuit of claims through litigation and the defense of bankruptcy claims in actions in Delaware, Florida, Chicago and Minnesota in various cases stemming from $4 billion ponzi scheme.
- In re Metromedia - Represented two investment banks that held $950 million of subordinated bonds, in their objection to, and subsequent appeal from the confirmation of the Debtors' plan of reorganization. After plan confirmation, argued issues of first impression relating to bondholder rights before the District Court and the Second Circuit Court of Appeals.
- VFS Financing v. Specialty Financial - Representation of secured lender as trial counsel in claims against corporate borrower and individual guarantor.
- In re Tousa - Representation of second lien lender in fraudulent transfer action brought by Creditors' Committee
- Representation of offshore liquidators in corresponding U.S. Chapter 7 bankruptcy proceeding, and negotiation of novel cross border protocol to govern same.
- In re Avianca - Representation of pilot's union in the bankruptcy of the national airline of the Republic of Colombia
- In re Jillians - In a case where senior lenders were not paid in full, secured subordinated investors a majority interest in the liquidation of the Debtors' assets through contentious negotiations.
- US AIR I and II - Representation of equipment trust trustee in pursuit of claims and disposition of aircraft and engines.
- In re PPL - Represented a power generator in the protection of their secured, unsecured and setoff claims in bankruptcy court and in related district court litigation
- In re Asarco - Represented the Official Committee of Unsecured Creditors
- In Tronox - Represented an indenture trustee as a member of the Creditors' Committee
- Representation of an international correspondent bank in litigation in state and district court
- Representation of equipment lessor and secured lender in state, federal and bankruptcy courts.
- Representation of hedge funds in counselling related to investment strategies, claim disputes, liquidation and regulatory actions.
In addition to the matters mentioned above, Ed's experience includes the representation of debtors and creditors in bankruptcy adversary proceedings, including numerous preference and fraudulent transfer actions, and the representation of clients in state and federal court litigation.
